About Texas
Texas gives you 30 days after the tenant moves out to refund the deposit or send a written description of the damages and charges. What makes it different from most states is the trigger: under Property Code 92.107 that obligation does not start until the tenant gives you a written forwarding address. No forwarding address, no 30-day clock. The tenant does not lose the right to a refund by failing to give one, so keep the money and the itemization ready rather than treating it as closed.

No statutory cap
- Texas does not limit how much you can charge for a security deposit. The amount is set by your lease.
Deposit return deadline
30 days after move-out
- Texas Property Code § 92.103. You must return the deposit or send an itemized deduction statement within 30 days.
Non-payment notice
3-day notice to vacate
- Texas Property Code § 24.005. A written 3-day notice to vacate is required before filing an eviction (forcible detainer) suit.
Month-to-month termination

- Either party must give at least one calendar month notice to end a month-to-month tenancy, unless the lease specifies otherwise.

- Texas has no statewide rent control. Local rent control ordinances are preempted by state law.
